A colleague of the Estavillo Law Group and founder of Foreclosure Defense Nationwide¸ Jeff Barnes, Esq., was successful in Florida Circuit Court where the Judge ruled in favor of the homeowners in a securitization case where Citibank was the “indenture trustee” for a Bear Stearns securitization.
The homeowners’ expert witness Richard Kahn, who is also one of the expert witness used by The Law Office of Jason W. Estavillo, PC testified that the Plaintiff did not acquire any interest in the Note or Mortgage.
Under Florida law, the homeowners may now seek recovery of their attorneys’ fees and costs as well from Citibank.
