Do you have a desire to sell the property and other family members don’t or vice versa? What are your options at that stage? So if you own a piece of property with a family member or family members. You have a right to force the sale of the property or they do too, or alternatively force you to be bought out or be bought out through a settlement.

The way to start that process would be to speak to an attorney and then they would make a recommendation most likely to file what’s called a partition action. A partition action forces the court to intervene to resolve the dispute by forcing the sale of the property through a third party referee. The goal in those situations typically is to try to get the parties to come to the table to resolve it without having to actually have bids made on the property in a court.

But ultimately that’s what would happen if you’re unable to come to an agreement to sell the property or to resolve it.
